Terms of Service
These terms govern use of the Party Table website and any order placed through it. Each numbered section states the rule and then answers the question most often asked about it.
1. Website use
Access to the site is granted on condition that it is used lawfully. Scraping, probing for vulnerabilities, submitting automated orders and any activity that degrades the service for other customers are prohibited.
Access may be suspended where fraud or persistent misuse is detected, and orders placed by automated means may be cancelled.
Credentials issued to a customer must be kept confidential, and Party Table should be told promptly if they may have been obtained by someone else.
A question that comes up regularly: what if part of these terms is not accepted? Then the site should not be used. Questions about an individual clause can be raised before an order is placed.
The site is provided on an as-available basis. Maintenance and security work may require part of it to be unavailable for a period, and where such work affects an order already placed the customer is contacted rather than left to discover it.
2. Orders and acceptance
An order is an offer to purchase. A contract is formed when Party Table confirms dispatch, not when the order is placed.
An order may be declined where an item is out of stock, where payment cannot be verified, where the delivery address is incomplete, or where fraud is suspected. Where an order is cancelled after payment, the full amount is refunded and a reason is given.
Order confirmation emails record the order received; the dispatch email is the point at which the contract is complete.
A question that comes up regularly: can an order be changed after it is placed? It can be amended while it is still in the packing queue, and any difference in price is refunded or charged before dispatch.
Where an item shown as available proves not to be, the customer is told before payment is taken rather than afterwards, and may cancel the remainder of the order at that point.
3. Prices and payment
Prices are shown in US dollars and may change without notice. The price confirmed on the order email is the price that applies to that order.
Sales tax is calculated at checkout from the delivery address. Payment is taken on the processor's hosted page, and full card numbers are never stored by Party Table.
The accepted methods are set out in the Payment Policy, which forms part of these terms.
A question that comes up regularly: what happens if a price was wrong? Where a price was displayed incorrectly because of a fault, the customer is contacted before dispatch and may proceed at the corrected price or withdraw for a full refund.
No surcharge is applied for paying by card, and no discount is offered for any particular method. Where a promotion has been applied, the discounted figure is displayed before the order is confirmed.
4. Delivery
Delivery dates are estimates rather than guarantees. Party Table is not responsible for delays caused by the carrier, severe weather, an incomplete address or a parcel that is not collected.
Risk passes on delivery, but where a parcel is lost or damaged in transit Party Table pursues the carrier and offers a replacement or refund once the claim is settled.
The full delivery terms, including the transit window and shipping charges, are set out in the Shipping Policy.
A question that comes up regularly: can a parcel be redirected after dispatch? It cannot. A delivery that fails because the address was wrong leaves the customer liable for the cost of retrieving and re-sending it, unless the error was Party Table's.
Where the carrier offers a delivery window or a collection point, that arrangement sits between the customer and the carrier once the parcel is in the carrier's network.
5. Returns and refunds
An item that has not been used may be sent back within 30 days of delivery, on the basis set out in the Return Policy, which is incorporated into these terms.
Refunds are issued to the original payment method within seven calendar days of the returned item passing inspection. The bank's own posting time is additional.
If a question about returns seems to be answered differently in two places, the Return Policy is the more detailed text and therefore controls.
A question that comes up regularly: does anything here reduce statutory rights? Nothing in this section reduces a right that cannot be excluded by agreement.
Returned items remain the customer's responsibility until they reach Party Table, which is why a tracked service is recommended for anything of value.
Where the original card has expired, write to [email protected] once the bank confirms the closure, and an alternative arrangement will be made.
6. Product care and safety
Disposable plates, napkins and covers are made for single use with food, and the printed items are not designed to be washed and reused. Keep every paper and plastic piece away from open flame and hot cookware, because the coatings and prints are not heat resistant.
Care instructions published on the product page, and on any label supplied with the item, form part of the basis on which the item is sold and should be followed.
Where the instructions supplied appear to contradict the product page, follow the instructions supplied and report the discrepancy so the listing can be corrected.
A question that comes up regularly: is damage from misuse covered? Damage arising from misuse, from disregarding care instructions, or from altering an item beyond its intended purpose is not covered by the Return Policy or by any warranty that may apply.
Care guidance is published for the customer's benefit and following it protects both the item and, where relevant, the person using it.
Where an item is supplied with a manufacturer's warranty, that warranty operates alongside these terms rather than replacing them.
Where an item arrives without instructions, or the instructions appear wrong for the item, tell Party Table before using it so the correct guidance can be confirmed.
7. Intellectual property
The text, photography, graphics, page layout and the Party Table name are owned by Party Table or used under licence and may not be reproduced without written permission.
Linking to a product page and quoting a short extract in a review or article is permitted, and images may be supplied for editorial use on request.
Third-party names and marks remain the property of their owners; nothing on the site grants a licence to use them.
A question that comes up regularly: can product photographs be reused? Not on another storefront or in paid advertising. For editorial use, write to [email protected] and permission is usually given.
Using the Party Table name, logo or photography in a way that suggests endorsement of, or connection with, another business is not permitted.
A request to use Party Table photography for editorial purposes is usually granted, provided the images are not altered and the source is credited.
8. Prohibited conduct
Submitting unlawful, abusive or misleading content through the site, using another person's payment details, or interfering with the security or availability of the service is prohibited.
Ordering goods with no intention of paying, or repeatedly returning used items as though the return policy were a lending service, is equally prohibited.
Accounts may be suspended while an investigation is open, and the reason for a suspension will be given.
A question that comes up regularly: what happens to a fraudulent order? It may be cancelled, and the activity reported to the relevant authorities. Future orders may require an alternative payment method while a matter is resolved.
From time to time an order may be held for a routine verification step. This is a check rather than an allegation, and it is released as soon as the details tally with the record.
Where a payment is reversed without contact, an alternative payment method may be required on future orders while the matter is resolved.
9. Limitation of liability
To the extent permitted by law, Party Table is not liable for indirect or consequential loss arising from use of the site or from the purchase of a product.
This section does not exclude responsibility for death or personal injury resulting from negligence, nor for fraud, and it does not remove any statutory right that cannot be set aside.
For any claim connected with an order, the maximum sum recoverable is the amount the customer paid for that order.
A question that comes up regularly: does this discourage raising a problem? It does not. Nothing here is intended to deter a genuine complaint, and no period within which a claim may be brought is shortened.
Where a product causes damage to property, the position depends on whether it was used as intended and on the terms of any manufacturer warranty; the options are explained once the circumstances are understood.
10. Changes to these terms
These terms may be amended to reflect changes in the business or in the law. The version published on this page is the version in force, and the date of the latest revision is shown at the top.
Continuing to use the site after an amendment indicates acceptance of the amended terms.
Amendments are not applied retrospectively to orders already placed; the terms in force at the time of purchase continue to govern that purchase.
A question that comes up regularly: can an earlier version be seen? Yes. Previous versions are retained and may be requested by quoting the order reference.
If a change materially reduces a customer's rights, that fact is stated at the top of the page rather than left to be discovered in the text.
Where an amendment is required by law, it takes effect from the date the law requires rather than the date of publication.
11. Governing law
These terms are governed by the law of the United States and of the state in which Party Table's registered office is located, disregarding conflict-of-law rules.
Should correspondence fail to settle a disagreement, both sides agree to try mediation before any claim is filed.
The courts of that state have exclusive jurisdiction, save that nothing prevents a consumer from using a consumer-protection body or small-claims procedure available locally.
A question that comes up regularly: does local consumer law still apply? It does. The governing law does not remove protections available under the consumer law of the customer's own jurisdiction.
Before any formal step is taken, write to Party Table with the order reference and a description of the problem; most disagreements are resolved at that stage.
The law that applies does not remove protections available under the consumer law of the state or country where the customer lives.
12. Contact us
Questions about these terms, or about a particular order, should be sent to [email protected].
For anything connected with a purchase, quote the order reference. Correspondence of a legal nature should be headed as such so that it is routed to the person responsible.
A reply is provided within one working day, Monday to Friday, and any clause that appears unclear will be discussed rather than left unresolved.
A question that comes up regularly: is a complaint handled differently? Correspondence about a formal complaint or a data request is logged and answered in writing, so both parties hold a record of what was said.
Where it is unclear which address to use, send the message to the address above and it will be routed internally rather than the customer being asked to guess.
Where a message concerns more than one subject, it will be answered in a single reply covering each point.
